Welcome to Nostalgia Central  ("the Site"). Please read the following Terms of Use carefully before using the Site so that you are aware of your legal rights and obligations with respect to Nostalgia Central and its parents, affiliates and subsidiaries (individually and collectively, "Nostalgia Central"). 

By using the Site you signify your irrevocable acceptance of these Terms of Use. Nostalgia Central has the right to revise the Terms of Use at any time without providing notice to its users. Your continued use of the Site shall be deemed irrevocable acceptance of those revisions.

Privacy

Your privacy is very important to us at Nostalgia Central. To better protect your rights we have provided the Nostalgia Central Privacy Policy (below) to explain our privacy practices in detail. 

Use of Materials

No material from the Nostalgia Central Site or any web site owned or controlled by Nostalgia Central ("Materials") may be copied, reproduced, republished, uploaded, transmitted or distributed in any way unless specifically authorised by Nostalgia Central, except that you may download one (1) copy of the Materials on a single computer for non-commercial, personal use only, provided that you keep all copyright, trademark and other intellectual property notices intact. Making modifications to the Materials is prohibited as is using the Materials on any networked computer environment or other website. 

Submissions

Nostalgia Central loves to get your feedback and to hear from you whenever possible. Any submissions shall be deemed the property of Nostalgia Central. Nostalgia Central shall exclusively own all now known or hereafter existing rights to the submissions throughout the universe in perpetuity and shall be entitled to use the submissions for any purpose whatsoever, commercial or otherwise, without compensation to the provider of the submissions. 

In any event, any submissions you send to Nostalgia Central will not be treated as confidential and Nostalgia Central shall not be liable for any disclosure of the submissions.

Community Guidelines

Please exercise respect when participating in any of Nostalgia Central's community features such as message boards, chats, e-mails, etc ("User Materials"). You may not submit or publish through Nostalgia Central any User Materials that are libellous, defamatory, pornographic, an invasion of privacy, obscene, abusive, illegal, racist, offensive, an infringement on any intellectual property rights of a third party or would otherwise violate the rights of any third party. 

Furthermore, you may not submit or publish User Materials through Nostalgia Central that solicit funds or services, contain advertising or include programs which contain viruses or any other programs designed to impair the functionality of any computer.

Please remember that Nostalgia Central does not monitor the contents of these community features and cannot be held responsible for the User Materials. Therefore, we apologise in advance for any offensive or otherwise displeasing User Materials.

Notwithstanding any rights or obligations governed by the Additional Terms, if any, any time you upload or post User Materials to the Site you automatically grant Nostalgia Central a non-exclusive, royalty-free, perpetual license of all rights throughout the universe to use, edit, modify, include, incorporate, adapt, record and reproduce the User Materials including, without limitation, all trademarks associated therewith, in any manner whatsoever, in or out-of-context, in all languages, in all media now known and hereafter devised, and to use the User Materials in advertising, promotion and publicity for the Site, Nostalgia Central and its or their products and services, in any and all media now known or hereafter devised. In addition, you represent and warrant that you are entitled to enter into these Terms of Use and that you waive any so-called "moral rights" in and to the User Materials.

Nostalgia Central may provide links to other sites that we feel are relevant and interesting to our users ("Link Sites"). Nostalgia Central is not responsible for the content of the Link Sites and is not responsible for the accuracy of the information and intellectual property notices therein. Nostalgia Central ("the Site") wants to do everything possible to protect the privacy of our users. This Privacy Policy tells you how we collect information from you, what kind of information we collect and what we may do with that information.

Copyright and Permissions

Most of the material contained at Nostalgia Central is available in the public domain . . . if you can find it out there! In the ten years I have written, published and served as Editor for Nostalgia Central, my office here at Nostalgia Central Towers has come to resemble one of those rooms you sometimes see in 1970's science-fiction movies.

You know the room . . . usually tucked away deep in the bowels of some high tech library (or Ministry of Truth/Propaganda) - the room with the bespectacled old eccentric gentleman serving as the curator of all the really old and dusty literature. Old newspapers, magazines, books, and comics litter the floor and every inch of free horizontal surface (I use old Matchbox cars as paperweights!). Album covers, liner notes, videos and more magazines are stacked against the walls.

The point is, finding this stuff has become a life's work. I regularly scour junk shops, libraries, car boot sales, second-hand book shops, little old ladies' attics - That's what Nostalgia Central is all about.

We're not trying to sell this stuff, we don't want to pinch it or plagiarise and pretend that we're gifted with super-computer-like memory (in fact, we probably argue more than you do about the names of The Hair Bear Bunch and such critical minutiae!).

Our aim is to provide a one-stop resource for our favourite four decades; to present the best (and worst!) of the 50s, 60s, 70s and 80s in a single website to provide fun and to aid in research, but mainly to help you recall things which give you a warm glow of recognition and take you back to a simpler time. Things you had given up hope of ever finding.

So what does this have to do with copyright? Well that's a very good question. And here's the answer . . . Although there is a lot of original writing here, much of what we present has been said or shown before in newspapers, magazines and books dating right back to 1950. So someone somewhere probably owns the copyright to a lot of this stuff.

We also talk about old TV shows, Movies and records, so once again, someone owns the copyright on the original product. We even show pictures of these things, and so someone once again blah blah blah.

This is where things become confusing . . .

The internet itself is surely going to force a re-think about all things pertaining to copyright and intellectual property. There will no doubt be much hearty and healthy debate (which we are happy to participate in) and also several court cases (which we are not!). All in all, the copyright lawyers should do quite nicely, thank you very much.

Add the international factor to this and things get seriously complex! For example, Nostalgia Central covers American, British, Canadian, Australian and European subjects while the actual site is hosted from the EU and the editorial team live in Australia, America and the UK.

What I'm getting at here is this: Where we know copyright to exist we will always try to quote it. If we include anything on the site which you believe you rightfully own or which infringes any right or law, there are a number of options:

You can let us know and we will attribute the copyright to you. Hopefully you'll also let us keep the content up for NC visitors to enjoy.

You can let us know and ask that we remove the content and we will comply.

You can sue us (which is obviously the most unattractive option, not least because we have no money!).

Nostalgia Central is essentially a museum. We just want to display this stuff to the world so it doesn't ever get forgotten. It really is a ticket to the time machine.

A time machine!? . . . hmmmmm. Now that sure would present a few problems for the copyright lawyers. Shagadelic, baby!
